Thanks for your response Greg, unfortunately just after I posted someone in
the #ubuntu+1 channel suggested using tseliot's script to uninstall then
reinstall the driver and now that it's done it's working better than ever!!
I have not yet resorted to an older kernel though since the dist-upgrade it
seems the 386 kernels don't work properly for me anymore and I've been using
the 686 series :) If you want to try the script you can find it and the
directions
